Medical Malpractice “Super Verdicts” on the Rise

According to research performed by Hiscox, a specialty insurer/reinsurer, the number of medical malpractice awards totaling $50 million or more has increased substantially in the recent years.

In the past two years, the awards in just seven medical malpractice cases totaled more than $1 billion, including a $670 million award for inadequate staffing at an assisted living facility, a $168 million award for brain damage after surgery, and a $144 million birth injury case. The year 2011 had seven states recording their largest ever medical malpractice awards.

In addition, the number of awards totaling more than $5 million went from 0.25% of all losses in 2000 to 0.7% of losses now, and is projected to increase to 1% of all losses by 2014.

Based on these “catastrophic losses,” insurers may reconsider premiums being charged, which may end up costing everyone more for health care.
