Suing Hospitals Over Productivity

February 29, 2012

An emergency physician who was removed from the schedule at Baptist Medical Center in Florida is now suing the hospital and her former employer, Emergency Resources Group after collecting information about how the “stopwatch climate” has harmed patients. An expert interviewed for the article stated that with productivity-based compensation “the incentive is to spend as little time with a patient as possible.”

Another story about the lawsuit is here.

Watch this case closely.

If there is liability found on behalf of the hospital or the group, it will open up a whole new theory of liability. If harm can be demonstrated from the productivity-based practice and a bad patient outcome occurs, the physician payment agreements may also come into play during medical malpractice cases.
